Chapter 5
Samuel Hugh & Julia Ann (Bennett) McWhirter

of
Marion County, Illinois
and
Cooke County, Texas

Samuel Hugh McWHIRTER, born in 1827, Wilson County, Tennessee, son of Charles and Nancy (GRIFFIN) McWHIRTER. He died 27 May 1907, Gunter, Texas. He is buried at Cottage Hill Cemetery outside of Celina, Texas.
Samuel married Julia Ann BENNETT 29 Jan 1848, Salem, Marion County, Illinois. She was born 1831, Tennessee. She died 29 May 1878, Salem, Marion County, Illinois. (Julia is also listed in records as Judah and Judith.) Julia Ann filed for divorce from Samuel 9 Mar 1858. They either got back together before the divorce went through or they remarried.
On 5 Nov 1850, the census shows Samuel (24) and Judy (18) McQUERTER living in Marion County, Illinois. Samuel and Judy were said to have been born in Tennessee. Sam was a farmer. Samuel could not read or write. With them were their children: Richard McQUERTER age 1; and Ann McQUERTER age 3. Both born in Illinois. (Note: When searching on ancestry.com, they have the name listed as Mc QUESTER, but on the actual census, you can see that it is spelled McQUERTER.)
In 1852, Judith A. McWHIRTER became a member of the First Presbyterian Church of Salem.
On 10 May 1853, Samuel McWHIRTER purchased 40 acres of land Section five, Tonti Township, Marion County, Illinois.
On 9 Mar 1858, Juda Ann McWHIRTER divorced Samuel McWHIRTER in Marion County, Illinois. (Note: The evidently re-married, but I find no record of it.)
On 10 Aug 1860, the census shows Sam (34) and Judah (29) McQUATER living in Salem Township, Marion County, Illinois. They were both said to have been born in Tennessee. Sam was a farmer. With them were their children: Richard age 11; Alice age 9; Nancy age 8; and Sarah E. age 2 months. All said to have been born in Illinois.
On 10 Jun 1870, the census shows Sam. H. (43) and Julia (38) McWHIRTER living in Salem Township, Marion County, Illinois. Sam was said to have been born in Tennessee and Julia in Illinois. Sam was a farmer. Sam's real estate was valued at $500.00. His personal property was valued at $100.00. Sam could not read or write. With them were their children: Richard age 21; Lizzie age 17; Ellen age 13; Willie age 5; and Effie age 1. All said to have been born in Illinois. (Note: If you search for this on ancestry.com, you need to look for John M. LYNCH, who was their neighbor. Sam H. McWHIRTER will not come up on a search.)
Shortly after 13 Jun 1870, after the birth of Charles, they moved to Texas.
By May 1878, they had moved back to Marion County, Illinois, as Julia died there.
On 20 May 1879, Sam owned land in Section 18 of Tonti Township. The property cost $200.00.
In 1884, Samuel H. McWHIRTER became a member of the First Presbyterian Church of Salem.
On 8 Jun 1900, the census shows the widowed Samuel AUGUSTUS age 74 living in Precinct 7, Cooke County, Texas. He was said to have been born Oct 1825, Tennessee. His parents were said to have been born in North Carolina. He was a day laborer. Samuel was living with his son and family, McWhirter (29) and Mattie (21) AUGUSTUS and their daughter Mary AUGUSTUS age 11 months. (Note: They placed Augustus McWHIRTER's name wrong on the census, therefore it appears like the last name is AUGUSTUS, therefore the search for the family should be AUGUSTUS.)
Samuel was buried in Collin, Texas, which is where his younger brother, John Houston McWHIRTER (See Chapter 18 for this family) and family lived. It is the county just southeast of Cooke County.
